Motor Vehicle Collisions in Montana

Montana’s wide-open highways and scenic backroads offer drivers stunning views—but they can also be the scene of serious motor vehicle collisions. With long distances between towns, changing weather conditions, wildlife crossings, and limited visibility on rural roads, Montana presents unique challenges for motorists. Unfortunately, these factors contribute to a higher rate of severe crashes compared to more urbanized states.

Montana follows a fault-based insurance system, meaning the driver who is found to be at fault for the crash is responsible for covering the damages. If you’ve been injured in an accident caused by another driver’s negligence—such as speeding, impaired driving, distracted driving, or failure to yield—you have the right to pursue compensation for medical expenses, lost wages, vehicle repairs, and pain and suffering.

Taking the right steps after a crash is critical. First and foremost, seek medical attention, even if injuries seem minor at first. Report the accident to law enforcement and gather as much evidence as possible—photos, witness names, vehicle information, and a copy of the police report. These details can be invaluable when filing an insurance claim or pursuing legal action.

Montana’s statute of limitations for personal injury claims is generally three years from the date of the accident, but the sooner you act, the better your chances of building a strong case. Insurance companies may try to minimize your claim or shift blame—having someone on your side to advocate for your rights can make all the difference.
